The plaintiff Philip Greenspun says that on November 1, 1994,
interrogatories were served upon the defendant Smyly Autos, Inc.
(and a copy has been filed in court), and the provisions of Mass.
R. Civ. P. 33(a) have been complied with; and that the party
interrogated has failed to serve a copy of the answers thereto
within forty-five (45) days.

WHEREFORE, the application is made that final judgment for relief
be entered as appropriate for plaintiff Philip Greenspun against
defendant Smyly Autos, Inc.
